This document sets out Burke & Smyth Real Estate’s condensed Privacy Notice. Burke & Smyth Real Estate (B&S) also has a full Privacy Policy, which contains information about how you may report a potential breach by Burke & Smyth Real Estate in the APPs or an applicable APP Code.

Information Collection, Use and Disclosure

During the course of your relationship with Burke & Smyth Real Estate, your personal information may be collected, used or disclosed, through the use of the B&S website www.burkesmyth.com.au, for the following purposes:

  1. Assisting you to sell your property;
  2. Assisting you to purchase a property;
  3. Assisting you to lease a property (either as lessor or lessee);
  4. Assisting you to obtain a loan;
  5. Assisting you with payment or refund of a bond;
  6. Assisting you with tenancy disputes;
  7. Coordinating repairs or maintenance of a property owned or leased by you;
  8. Recording or accessing information at the Titles Registry Office or other government agency;
  9. Recording or accessing information at the Residential Tenancies Authority;
  10. Recording or accessing information on tenancy information services or databases;
  11. Client and business relationship management;
  12. Marketing of products and services to you;

The types of personal information B&S may collect, use or disclose about you includes, but is not limited to:

  1. Your full name;
  2. Your date of birth;
  3. Your residential address;
  4. Your postal address;
  5. Your email address;
  6. Your home telephone number;
  7. Your work telephone number;
  8. Your mobile telephone number;
  9. Your occupation and business address;
  10. Financial information including details of your employer, income, name of bank or financial institution;
  11. Details of your spouse, de facto, dependent children, and roommates;
  12. Details of properties owned by you;

In order for Burke & Smyth Real Estate to provide suitable products and services to you, your personal information may be disclosed to the persons/organisations described below:

  1. In the event that you are a seller or a lessee, we may disclose your personal information to prospective buyers of the property owned or leased by you;
  2. In the event that you are a buyer or a lessee, we may disclose your personal information to the sellers of the property you are purchasing or leasing;
  3. Your legal advisor(s) and the legal advisor(s) representing the other party(ies) involved in your transaction;
  4. Your financial institution and/or financial advisor;
  5. Insurance providers and brokers;
  6. Utility providers and utility connection service providers;
  7. Persons or organisations involved in providing, managing or administering your product or service, including independent contractors engaged by B&S as real estate agents;
  8. Tradespeople engaged by B&S to repair or maintain a property owned or leased by you;
  9. Organisations involved in maintaining, reviewing and developing B&S business systems, procedures and infrastructure including maintaining or upgrading B&S computer systems;
  10. Persons or organisations involved in purchasing part or all of the B&S business;
  11. B&S related companies;
  12. Organisations involved in the payment systems including financial institutions, merchants and payment organisations;
  13. The Titles Registry Office or other government agencies;
  14. The Residential Tenancies Authority;
  15. Police;
  16. Tenancy information services or databases;
  17. Real estate websites;
  18. Real estate peak bodies;

Whenever it is reasonable or practicable to do so, B&S will collect your personal information directly from you. Sometimes it will be necessary for B&S to collect information from a third party or a publicly available source, such as a credit reporting agency, your legal adviser, your past or current employers, your previous lessors or property managers, and tenancy information services or databases.

During the process of providing services to you, it may be necessary for B&S to enter your personal information into forms generation software and real estate websites. Depending on the terms of use of such software and websites, a third party may acquire rights to use or disclose information entered into the relevant forms or websites.

B&S may disclose your personal information to recipients within Australia or overseas. Should information be required to be sent interstate or overseas, B&S will take the necessary steps to protect the privacy of your information.

B&S requires your permission to collect, use and disclose your personal information, and ask that you sign the consent acknowledgement on the first page of this document.

In the event that you do not consent to Burke & Smyth Real Estate collecting and providing your personal information as described above, B&S may be unable to provide the services requested by you.

Access to, and correction of personal information

You have the right to request access to your information stored and to request that Burke & Smyth Real Estate to update or correct your personal information.

B&S’s Privacy Policy contains further information about how you may request access to, and correction of, your personal information.  An administration fee charge may apply for providing access to your information.
